This Rental Agreement - Terms and Conditions constitutes a contract between the renter, hereinafter referred to as “Guest” and Graeagle Meadows Vacation Rentals acting as Agent and hereinafter referred to as ”Agent” under this Rental Agreement and includes any amendments to the Rental Agreement that Agent may publish from time to time. Please read this Rental Agreement thoroughly. Any monies received by Agent for occupancy of vacation property indicate the acceptance of the terms and conditions of this Rental Agreement. It is the responsibility of the Guest to be familiar with all terms and conditions within this agreement.
Payment An advance payment deposit of $300 is required to confirm the rental property and to reserve the desired rental dates. We accept Visa and MasterCard credit cards. The remaining rental balance is due at Guest check-in date and will be automatically charged to the Guest credit card associated with reservation unless other arrangements have been made in writing and agreed to by the Agent. Reservations made 30 days or less prior to the check-in date will require full payment.
Cancellation & Refund Policy Should Guest wish to cancel this Rental Agreement, notice of cancellation must be in writing and mailed or e-mailed to Agent. It is Guest’s responsibility to verify receipt by Agent. If written cancellation is received 31 days or more prior to check-in date, Guest will receive a refund of deposit less a $75.00 cancellation fee. If the notice of cancellation is received 30 days or less prior to check-in date, the entire deposit payment is non-refundable. There are no refunds for early departures, delayed arrivals, inclement weather or reduction in the number of nights reserved. We will make every reasonable effort to ensure that all appliances, grills and like amenities are and remain in good working order. However, there is no refund if these are inoperable. Internet service, if available, is provided as a convenience at no charge to you; there is no refund for unsatisfactory internet service. Agent strictly enforces this policy and will make no exceptions whatsoever.
Check-In Standard check-in time is 3:00 pm. Every effort will be made to ensure property is available by 3:00 pm, but it is not guaranteed. Agent may be able to accommodate an early check-in, however, it must be arranged 24 hours in advance of check-in date and cannot be guaranteed. Upon Check-in, the Guest is required to report any issues or problems with the property(s) they have rented in-order to avoid being charged for damages that were caused by a past guest and will help us to keep the property in its best possible condition.
Check-Out Check-out time is 11:00 am. All requests for a late check-out must be made in advance with Agent.
Occupancy Guest understands and agrees that the Property will be occupied by no more than the maximum number of people indicated on the Rental Confirmation. Violation of this rule will result in immediate eviction and all payments and deposits will be forfeited. Please be respectful and considerate of neighbors in the area after 10:00 pm and before 7:00 am. Loud parties, noise or other disturbances will not be tolerated and deemed grounds for immediate eviction and all deposits and payments forfeited.
Accommodations Guest is renting a privately-owned, fully-furnished home that has been decorated and equipped to satisfy the particular taste and desires of the owner. Towels and linens are provided, and the kitchen is well-equipped for meal preparation and serving. Dishwashing liquid, dishwasher detergent, garbage bags, and laundry detergent is provided along with all paper products. Under no circumstances should any items in the property be transferred to another property. Please be considerate of the belongings of the owner and take adequate care to avoid needless damage to the home and its furnishings, be conscientious about energy usage (avoid running the heat unnecessarily and leaving lights on). Treat carpets with care as you will be charged $125 or more if carpets are soiled excessively. A cleaning charge is included in Guest rent; however, if excessive cleaning is required after departure, an additional charge will be added to Guest credit card.
Rate Changes Rates are subject to change without notice. If a discrepancy arises between the rate quoted on Agent website and on the confirmation, the latter will prevail. In the event an incorrect rate is charged due to a typographical or other error, Agent shall have the right to refuse, cancel or limit any reservations listed at the incorrect price, whether or not a confirmation has been sent and/or payment has been made.
All Properties are Non-smoking Absolutely no smoking in any rental property. A $1,000 Deep Clean charge will be assessed to the Guest if Agent determines smoking has taken place inside the property and Guest will be immediately evicted with no refund. Plumas County is a high wildfire danger area, and all Guests are expected to exert extreme caution when smoking outside.
Relocation When reservations are confirmed, a property will be assigned, however, no property request is guaranteed. Agent reserves the right to substitute comparable accommodations without notice or liability in the event of a sale of the rental property or if the property becomes unavailable due to owner usage or other circumstances beyond our control.
Consideration All efforts are made to correct any problems Guest may experience in as timely a manner as possible, and Guest can expect a courteous and professional attitude toward problem solving. Keep in mind, however, we are a rural community, with a limited number of qualified service personnel, as a result, dispatching a service technician may take up to 24 hours. Recompense will not be issued due to malfunctioning equipment or other guest’s dissatisfaction.
Pets The majority of our properties do NOT allow pets. Our few pet-friendly properties require a non-refundable pet fee of $75.00. Violation of the no-pet policy will result in eviction and all deposits and payments forfeited.
Listings & Pricing Information regarding the rental homes is believed to be accurate but cannot be guaranteed. Agent has made every effort all the information on our website and brochure is current and accurate. The possibility of errors and omissions exists. Agent will be happy to confirm all data or answer any questions Guest may have prior to booking your reservation. Prices are subject to change without notice.
Keys Please return all keys to office at check-out. Guest credit card will be charged $25.00 for all lost, unreturned, or missing keys.
Termination If Guest or any member of Guest’s party or visitors violates the terms of this Agreement, Agent may terminate this Rental Agreement with no refunds. Agent has the right to inspect the premises without prior notice at any time to enforce the terms of this agreement. Guest agrees that conduct that disturbs or offends other guests or residents shall be deemed grounds for immediate termination. Should the Guest violate any of the terms of this agreement, or use the property for any illegal or unlawful purpose or use of common areas in a manner contrary to the provisions of the Rental Agreement, the rental period shall be terminated immediately with no refunds. All Guests must vacate the property at the conclusion of the rental period. If a Guest fails to vacate the premises upon termination of the rental period, Guest shall waive all rights to due process. Agent may enter the premises and remove Guest, the members of Guest`s party and their belongings. Guest is notified that all individuals occupying the rental property will be subject to immediate eviction procedures under State law.
Hold Harmless Tenant and Tenant’s Guests shall hereby indemnify and hold harmless Manager, its subsidiaries, affiliates, officers, directors, agents, employees, co-branders or other partners, and suppliers, from any claim, demand, action or damage, including reasonable attorney’s fees, made or incurred by any third party arising out of or related to your use of the property(s), any content you transmit via the property(s), or your violation of the Terms. Guest, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Manager and Owner from any and all claims, demands and causes of action by reason of any injury of whatever nature which has or have occurred, or may occur to the Guest, or any of his/her occupants or guests as a result of, or in connection with the occupancy of the premises and agrees to hold Owner and Manager free and harmless of any claim or suit arising there from. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assigns the prevailing party shall be entitled to recover reasonable attorney fees and costs.
Changes to the Terms Agent reserves the right, in its sole discretion, to change, modify, add or remove any portion of the Rental Agreement in whole or in part, at any time. Changes in the Terms will be effective when notice of such change is posted on the Rental Policies section of the graeaglevacationhomes.com.livereznetwork.com website. Guest continued use of the property(s) after any changes to these Terms are posted will be considered acceptance of those changes. Guest should periodically check the Rental Policies link on Agent website to view the then current Terms.
